Official Rules and Regulations
The CAA Member Experiences® Contest Powered by Trafalgar (the “Contest”) is intended only for residents of Canada, who have reached the age of majority of their province or territory of residence at the time of entry. This Contest will be interpreted according to federal and provincial law. CAA National (hereafter referred to as the “Sponsor”) will conduct the Contest.
1. CONTEST PERIOD:
The CAA Member Experience® Contest Powered by Trafalgar begins on July 16, 2017 at 12:00:01 AM ET and concludes August 15, 2017 at 11:59:59 PM ET, the Contest Closing Date (hereafter referred to as the “Contest Period”).
Employees, officers, and directors (including immediate family members and members of the same household of such persons, including common law spouses) of CAA National (the “Sponsor”) and/or its affiliated regional CAA motor clubs (the “CAA Clubs”) their affiliates, prize suppliers, advertising/promotion agencies and any entity involved in the development, production, implementation, administration, judging or fulfillment of the Contest are not eligible to enter the Contest. Entries may be made only by the original, manual keystrokes of the individual entrant without assistance of any kind including mechanical, form filling, other software or robotic assistance. By participating in this Contest, you signify your agreement that you have read and agree to be legally bound by the terms and conditions of these Official Rules and Regulations (the “Rules”).
3. HOW TO ENTER
No purchase necessary. To register for the contest and to receive one (1) Contest entry go to www.caa.ca/memberexperiences or https://www.caa.ca/club-services/caa-rewards-redirect/ to be taken to the Contest Entry Form. Complete the Entry Form with your first name, last name, email address, daytime telephone number, CAA membership number, confirm you are of the legal age of majority in your province/territory of residence, and indicate that you have read, understood, and accept the Official Rules by checking the appropriate box and select “Submit” to submit your entry. Limit one (1) entry per person per day (regardless of the email addresses, telephone numbers or addresses provided throughout the Contest period).
If it is discovered that you attempted to enter more than once each day during the Contest Period, then all of your entries in this Contest will be disqualified. Multiple registrations during the Contest Period by the same person using any device or method to register multiple times or as multiple Contestants will result in disqualification.
By entering this Contest, you agree to be bound by the decisions of the Contest Sponsor, which are final and binding, without right of appeal with respect to all matters relating to the Contest.
Non CAA Members may also enter the Contest by writing your first name, last name, complete mailing address including street address, city, province and postal code on a card or sheet of paper not exceeding 8.5 X 11” and mail to CAA Member Experiences® Contest, 20440 Simcoe St., Seagrave, ON, L0C 1G0. You may enter as often as you wish, but each mail-in entry must: (i) Hand written sending and return address on envelope (ii) mailed in a separate envelope, bearing sufficient postage (iii) post-marked by no later than the end of the Contest Period; and (iv) must be received at the above address by no later than August 15, 2017. No responsibility will be taken for mail-in entries that are delayed, lost, misdirected or damaged.
One (1) Grand Prize will be awarded. The Grand Prize trip consists of a trip for two (2) on an eleven (11) day, ten (10) night Enchanting Canadian Maritimes Tour with Trafalgar. The Grand Prize also includes: round trip airfare (economy class) for the winner and his/her travel companion from the Canadian International airport nearest the winner's residence to Halifax. The tour includes a city tour of Halifax, Charlottetown and Lunenburg, cruise on Bras D’Or Lake and Shediac Bay, scenic drive along The Cabot Trail, visit to the Maritime Museum of the Atlantic, Alexander Graham Bell National Historic Site, Prince Edward Island, Green Gables House, Hopewell Rocks and Peggy’s Cove. Departure dates include: September 9th, 16th & 30th 2017 - pending availability prize booking is valid through till August 31, 2018. The Grand Prize has an approximate retail value of $9,000 CDN based on a Vancouver, BC departure. The winner is not entitled to the monetary difference between the actual prize value and stated approximate prize value, if any. Prize must be accepted as awarded and is not transferable or convertible to cash. The Grand Prize winner and guest must travel on the same itinerary; and, have all necessary documentation to permit travel (e.g. valid photo identification and passport). Trafalgar reserves the right to change the terms and conditions of the Grand Prize trip details from time to time with or without notice to the extent permitted by applicable law. The Grand Prize trip may be taken September 30, 2018.
All fees and expenses, other than those expressly described as being part of the prize, are the sole responsibility of the winner and guest, including transportation to and from their residence(s) to the closest Canadian international airport, meals (other than those specified in the itinerary), beverages, telephone calls, in-room charges, hotel services, personal insurance, gratuities, taxes and tips, incidentals, personal expenses and spending money.
The arrangements related to the trip must be made by the Grand Prize winner with a Travel consultant from CAA Travel within one (1) month of being confirmed as the winner, or such other time agreed to by the Sponsor. The Grand Prize winner’s guest must be over the legal age of majority and must travel on the same itinerary as the Grand Prize winner. No changes will be accepted once the arrangements have been completed and if the Grand Prize winner or guest is not able to travel on the dates specified after booking, no re-booking will be granted and the prize will be forfeited. The Grand Prize winner and guest must respect and comply with the terms and conditions of the prize suppliers (e.g. airline, hotel, etc.). the Sponsor does not assume responsibility for cancelled, delayed, suspended or rescheduled trips after ticketing of the prize for any reason whatsoever.
5. NOTIFICATION AND QUALIFICATION OF SELECTED ENTRANTS
On or about August 18, 2017, the “Draw Date”) in Seagrave, Ontario at approximately 2 pm ET, one (1) Grand Prize eligible winner will be selected by random draw from among all eligible Entries received during the Contest Period. The odds of winning depend on the number of eligible Entries received throughout the Contest Period.
In order to be declared a winner by the Contest judges, the potential winner must be in compliance with these Official Contest Rules and Regulations and, in particular, the following: selected entrant must first correctly answer, unaided, a time-limited, mathematical skill-testing question. Eligible Prize Winner and his/her guest will be notified by email and/or telephone and will be required to sign and return a declaration of eligibility and a liability/publicity release pursuant to which the Prize Winner and his/her guest releases the Sponsor, its affiliated and related companies, advertising and promotional agencies, the independent contest organization and their respective shareholders, directors, officers, owners, partners, dealers, employees, agents successors and assigns (the “Releasees”)from and against all liability in connection with the Promotion and the awarding and use or misuse of the Prize and consents to the use of his/her name, address (city and province) voice, statements and/or photographs, without further remuneration, in connection with any publicity carried out by or on behalf of the Sponsor within ten (10) business days of notification. If the selected prize winner cannot be contacted by mail, email or telephone or fails to correctly answer the skill testing question or fails to return the Contest documents within the specified time, he/she will forfeit their prize and an alternate winner will be randomly selected without any liability to original potential prize winner to Sponsor whatsoever.
All entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the official Contest rules and regulations may be disqualified by the Sponsor. Sponsor will not be responsible for lost, stolen, delayed, damaged, misdirected, late or destroyed entries, or for any problems or technical malfunctions of any telephone network or lines, computer online systems or servers, computer software problems or traffic congestion on the internet or at any website and assumes no liability for damage to entrant's or any person's computer resulting from participating in the Contest. Sponsor is not responsible for any errors or omissions in printing or advertising this Contest. All entries become the property of the Sponsor and will not be returned. All entries made by robotic or other automated means will be disqualified.
By entering this Contest, entrants release and hold harmless the Sponsor, its affiliated companies, advertising and promotional agencies and the Contest judge(s), and their respective directors, officers, owners, partners, employees, agents, dealers, representatives, successors and assigns (collectively the “Releasees”) from any liability in connection with this Contest or, if declared a winner, the prize. By accepting a prize, winners consent to the use of their name, place of residence, voice, statements, photographs or other likenesses for publicity, advertising or informational purposes in any medium or format without further compensation or notice.
This Contest will be run in accordance with these Official Contest rules and regulations, subject to amendment by Sponsor. Contest entrants must comply with these rules, and will be deemed to have received and understood the rules by participating in the Contest. The terms of this Contest, as set out in these rules, are not subject to amendment or counter-offer, except as set out herein.
If the identity of an entrant is disputed, the authorized account holder of the e-mail address submitted at the time of entry will be deemed to be the entrant. The individual assigned to the e-mail address for the domain associated with the submitted e-mail address is considered the authorized account holder. A selected entrant may be required to provide proof that he/she is the authorized account holder of the e-mail address associated with the selected entry. The sole determinant of time for the purposes of receipt of a valid entry in this Contest will be the Contest’ server machine(s).
The Sponsor reserves the right, subject only to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) in Quebec, to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor, with the consent of the Régie, reserves the right to cancel, amend or suspend this Contest, or to amend these Rules, without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason.
For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of the prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
The Sponsor reserves the right, in its sole and absolute discretion, and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any Member, Non-Member, Registration and/or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.
The eligible Prize Winner agrees to cooperate in any investigations by or on behalf of Sponsor to confirm their eligibility and to help ensure that the use of any such potential winner and/or their photo in advertising or publicity for the Contest will not bring the Sponsor into public disrepute, contempt, scandal or ridicule or reflect unfavourably on the Contest or the Sponsor as determined by the Sponsor in its sole discretion.
